Elder LawElder Abuse

The Elder Abuse and Dependent Adult Civil Protection Act provides extra legal protection for seniors from physical, emotional and financial abuse. Sadly, elder abuse has been on the rise in recent years due to an aging population and increased opportunity. If you are an adult over the age of 65 and you believe that you are victim of Elder Abuse you should first contact the Adult Protective Services Agent in your area and then contact an attorney for further advice and assistance with stopping the abuse.

Estate PlanningEstate Planning

Estate Planning is not just for the senior client. Every person should have a plan in place to make sure his or her loved ones will be taken care of. Estate Planning includes planning for the management of one’s estate during life as well as its disposition on death through trusts, wills, health care directives and and other planning documents. The Law Office of Lael K. Brown offers a variety of estate planning packages to prospective clients at flat rates. It is our policy to have the client meet first with the attorney to determine his/her estate planning needs before advising the client as to the best plan to put in place. Though a living revocable trust is often a key element of good estate planning, it is not always necessary depending on the client’s situation and should not be arbitrarily drafted unless it really is in the best interest of the client.

Probate/Trust Administration and LitigationProbate

Probate is the legal process of administering an estate of a deceased person by resolving all claims on the estate and distributing the deceased person’s property. The probate process is typically a lengthy and complicated one, and can take up to a year to be completed. The Law Office of Lael K. Brown can provide assistance with probate either through full scope representation or by providing advice and assistance to the pro se personal representative. Our office also assists with transferring assets outside of probate whenever possible.

Probate/Trust Administration and LitigationTrust Administration

Administering a Trust upon the death of the Settlor (one who created the Trust) is generally not as complicated or costly as going through probate which is why trusts have become so popular. However, there are still steps that must be taken to administer the trust: assets of the trust must be appraised and inventoried, beneficiaries must be notified, issues can arise with regard to title of assets under the trust, etc. The Law Office of Lael K. Brown can provide reasonably priced legal assistance to the trustee who needs help with administering the trust or understanding his/her fiduciary duties.

A Conservatorship is a proceeding initiated and supervised through the court system whereby a person appointed by the court assumes responsibility for the interests of another deemed incapable of managing his or her own interests. A Conservatorship for a loved one should never be contemplated unless all other less restrictive alternatives have been considered. Unfortunately, it is sometimes the only means available to protect a loved one from those who would take advantage of him/her. A Conservatorship often becomes necessary when an individual becomes ill but has no plan in place for his/her care.
